Abstract

Knowing that the affiliation towards mother is established and proven by the material fact of the birth, affiliation towards the father raised certain issues, in the context in which the family code establishes distinctly the paternity of the child from marriage and the one outside the marriage, because the way of establishing the affiliation towards the father is determined differently, depending on the legal situation of the child. The future and much anticipated reform, in matters of national and international adoption, must consider not only the law proposals in the specialized literature and the jurisprudence guidelines, but also the social realities of Romania.
