Abstract


The freedom of the person is guarded by Romanian criminal law. In essence, an infringement of lack of freedom unlawfully consists of the suppression or the unduly restrict freedom of the movement and of the action of a person. The article 189 of the Penal Code stipulates that such a simple form of crime but also aggravated forms, must take into account a number of eight circumstances or occurrences which give to the action increased danger to social protection.
