Certains Aspects Concernant le Droit des Citoyens Roumains Mineurs de Voyager à L’étranger

Gabriela Lupsan

Abstract

The Romanian citizen’s right to travel in the European countries presents few particularities, in the case of minors. Under the parental care and under the Romanian state protection, children enjoy special conditions settled by the law. In article 2, paragraph 2 of Law no. 248/2005 regarding the regime of free circulation of the Romanian citizens abroad, Romanian minors may travel abroad only accompanied, with the consent of their parents or of their legal representative. The legal representative is the person designated by law to exercise their rights and to fulfil their parental obligations towards the minor.
