The Distinction between the Generic Content and the Specific Content of the Incrimination

Abstract


This paper deals with the relation between the notion of „offence” and the notion of its „content”. As the Romanian legislation defined the offence as a real act, the relation between the two can be one between a notion of gender and one of species; on the contrary, they are two independent notions.
