The Lisbon Treaty and the New Dimensions of the Principles of Proportionality and Subsidiarity
Abstract
The general objective of the paper was constituted on an extremely present subject of real interest. Using the content analysis thorough a descriptive documentary research this study aims at identifying the new dimensions of the principles of proportionality and subsidiarity after the Lisbon Treaty. For this end, an analysis of the specific objectives was performed: the concept of proportionality, the evolution of subsidiarity and the new valences of the two principles in the framework of the modifications introduces by the adoption of the Lisbon Treaty. We assert thus that in virtue of these modifications, the application of the principles of proportionality and subsidiarity has the purpose of maintaining the institutional balance, as the subsidiarity establishes which of the competencies belongs to the state or community institutions and the proportionality indicates the dimensions of applying the legislative measures.
