Fraudulent Crossing of State Border According to the Romanian Criminal Law

Abstract


In the paper we have examined the fraudulent offense of the state border of Romania in terms of the regulations in force. During the examination, we had in view a comparative examination between the regulation in force and the regulation in the previous law, in which we have highlighted some elements of similarity but also differences, extremely important aspects from the perspective of the application of the more favorable criminal law.

We have also analyzed the background, constitutive content, forms, modalities, some procedural aspects, and the transient situation. The novelties brought concern the examination of the offense in the light of the new law, as well as some aspects concerning the transitional situations. The work may be useful for students from law schools in the country, as well as practitioners in the field of criminal law.
