Abstract

In the paper, we have investigated the offense of facilitation of illegal stay in Romania, in the light of the provisions of the new Criminal Code. We have considered the comparative examination of the provisions of the previous law with those of the current incrimination text, the examination of the pre-existing and constitutive elements of the offense, some procedural aspects, as well as the transitory situation in which we are. The proposed novelty is the analysis of the offense committed in accordance with the new provisions of the law in force, as well as in some aspects regarding the criminal prosecution and trial procedure, or the application of more favorable criminal law. The paper may be useful to students of law faculties, as well as to practitioners in the field of criminal law.
