Mediation As An Alternative Manner of Dispute Resolution in Kosovo

Abstract


Mediation as an alternative manner of dispute resolution in Kosovo is innovation. Kosovo as a new state which in 2008 has declared its independence, it’s a coincidence because at the same year has entered into force the Law on Mediation. The Law on Mediation has been drafted by harmonizing with laws of European countries on Mediation. The proper establishment and functioning of mediation in Kosovo has started in 2011, and if we take a look at practical functioning we see that mediation has begun positively if compared to region countries, by having in mind the years since has been practiced. The scientific paper except presenting establishment, resolved cases is important for readers due to the fact there shall be presented also principles of mediation and its importance in mediation procedure as well as advantages of parties to mediation in relation to courts. At the end of this scientific paper has been presented several conclusions and recommendations.
